Being arrested for lack of Common Sense.

okay, this morning, I was listening to k92 fm (a country station in Florida) and they talked about the flooding that Irene did in the northeastern coast. Well, minus ppl in New york being stupid and diving into the water for a swim, two guys in Philly decided to go rafting. They were stopped by some cops and were arrested.The charge was: Lack of Common Sense.
Okay, anyone besides me think that that's a little off? I mean it could just be in Philadelphia, Pennsylvania, but still, if that's a real charge, shouldn't over half the teenagers in America be in prison right about now?

More so, shouldn't half the people in America in general be charged?
